Ms. Halicki vows to seek further review of the May 27, 2025 decision of the United States Court of Appeals for the Ninth Circuit concerning copyright protection of motion picture characters like Eleanor (9th Cir. case No. 23-3731). Said Ms. Halicki: “We respectfully disagree with the Ninth Circuit’s decision. We believe that it does not follow the Circuit's own standards for determining copyright protection for characters, and that it is inconsistent with prior Ninth Circuit decisions strongly indicating that Eleanor is a copyrightable character. We intend to seek further review in the Ninth Circuit, and if necessary, the United States Supreme Court.”
